1. Acceptance of Terms
By creating an account or using MarketMoto, you agree to these Terms of Service. If you do not agree, do not use the app.
2. The Marketplace
MarketMoto is a peer-to-peer marketplace for buying and selling motorcycles, parts, gear, and accessories. We are not a party to any transaction between buyers and sellers. We do not own, inspect, or guarantee any listed items.
3. Eligibility
You must be at least 18 years old to use MarketMoto. By using the app you represent that you meet this requirement.
4. User Conduct
MarketMoto has zero tolerance for objectionable content or abusive behavior. Content that is harassing, threatening, hateful, obscene, defamatory, or otherwise objectionable is strictly prohibited, and users who engage in abusive behavior toward others will have their content removed and their accounts terminated. By using MarketMoto, you agree to these standards. You agree not to: • Post fraudulent, misleading, or illegal listings • Post objectionable, obscene, hateful, or harassing content • Harass, threaten, or abuse other users • Use the app for any purpose other than buying and selling motorcycle-related items • Attempt to circumvent the platform by completing transactions outside the app after initial contact • Post content that infringes on intellectual property rights • Submit false or malicious reports against other users or listings • Create multiple accounts to circumvent blocks or suspensions • Manipulate ratings or reviews through fake accounts or coordinated activity
5. Listings
You are solely responsible for the accuracy of your listings. Items must be accurately described and photographed. The following items may not be listed on MarketMoto: • Stolen goods, or items with altered, removed, or obscured VINs or serial numbers • Counterfeit or replica parts and gear represented as genuine • Emissions defeat devices — any part whose principal effect is to bypass, defeat, or render inoperative an emissions control system, including catalytic converter delete pipes, O2 sensor eliminators, and ECU tunes that disable emissions equipment • Helmets or protective equipment represented as meeting DOT, ECE, or other safety certification when they do not • Items requiring a licence or permit to sell that you do not hold • Recalled items that have not been repaired to the manufacturer's specification • Any item that is illegal to sell in the buyer's or seller's jurisdiction Listing an item does not mean it has been reviewed or approved. If you believe a listing violates these rules, report it through the app or email [email protected]. We may remove listings and suspend or terminate accounts for violations. The app offers an AI-assisted import feature that extracts listing details from a screenshot. You are responsible for reviewing and correcting any AI-generated content before publishing. Content submitted through this feature is processed by a third-party AI service (Anthropic) solely to populate your listing fields. Sellers may add keyword tags to improve discoverability. Tags must accurately describe the item and may not be used to mislead buyers or manipulate search results. Sellers may delete their own listings at any time. Doing so removes the listing from public visibility, but if buyers have previously interacted with the listing through messaging, offers, or completed transactions, those interactions remain visible to the buyer for their transaction history. Sellers cannot erase a buyer's record of a completed transaction. We reserve the right to remove any listing at our discretion.
6. Transactions
MarketMoto does not process payments. All payments are arranged directly between buyers and sellers. We strongly recommend meeting in a safe public location for in-person transactions and using a tracked payment method. MarketMoto provides an in-app offer and counter-offer system to facilitate price negotiation. Buyers and sellers may exchange offers and counter-offers through the in-app messaging system. Acceptance of an offer constitutes an agreement between buyer and seller. MarketMoto is not a party to this agreement and does not guarantee completion of any transaction. Accepting an offer does not automatically mark a listing as sold — the seller must confirm the sale separately after the real-world transaction is complete. Sellers may withdraw their acceptance of an offer prior to marking the listing as sold, which returns the listing to an active state and allows another offer to be accepted. Buyers cannot withdraw their offers after the seller has accepted; if the buyer no longer wishes to proceed, they should communicate with the seller through in-app messaging. Sellers may use the "Offer to savers" feature to send a discounted offer to users who have saved their listing. These are seller-initiated offers sent through the in-app messaging system and are subject to the same terms as any other offer. To prevent unwanted repeat outreach, sellers may not send more than one such offer to the same saver within a 24-hour period; however, sellers may continue to send offers to additional savers as new users save the listing. We are not responsible for items lost, damaged, or not received, or for fraudulent transactions.
7. Ratings and Reviews
Ratings and reviews must be honest and based on actual transactions. We reserve the right to remove reviews that violate our content guidelines or these Terms.
8. Reporting and Blocking
Users may report listings or other users that violate these Terms of Service or community standards. Reports are reviewed and may result in content removal, account suspension, or permanent termination at our discretion. Users may block other users to prevent them from viewing their listings or sending messages. Blocked users are not notified of the block. The report and block systems exist to maintain community safety. Misuse of these systems — including submitting false reports, coordinated reporting, or using blocks to manipulate marketplace visibility — is a violation of these Terms and may result in action against the offending account.
9. Intellectual Property
MarketMoto and its original content, features, and functionality are owned by Marketmoto Technologies and are protected by applicable copyright and trademark law. You retain ownership of content you post, but grant us a non-exclusive licence to display it within the platform.
10. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETMOTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP OR ANY TRANSACTION CONDUCTED THROUGH IT.
12. Termination and Account Deletion
We may suspend or terminate your account at any time for violations of these Terms. Users may delete their account from the Profile screen. Upon deletion, your authentication credentials are removed and your profile is anonymized. Active listings are deactivated, pending offers are cancelled, and saved searches are deleted. To preserve transaction context for other users, your name is displayed as "Deleted User" in conversations and on prior listings, and conversations remain visible to the other party in a read-only state. Personal information beyond what is needed for transaction continuity is purged. Account deletion is irreversible.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the updated Terms.
14. Notifications
By creating an account, you consent to receive push notifications related to messages, offers, counter-offers, and account activity. You may disable notifications in your device settings at any time. If you create saved searches, you may also receive push notifications when new listings match your saved search criteria. Saved search notifications are rate-limited and can be individually enabled, disabled, edited, or deleted from within the app.
15. Dispute Resolution
In the event of a dispute, users agree to contact MarketMoto at [email protected] before pursuing legal action. MarketMoto does not mediate disputes between buyers and sellers and is not responsible for resolving transaction disagreements.
16. Governing Law
This Agreement is governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
17. Force Majeure
MarketMoto is not liable for any failure or delay in performance due to circumstances beyond its reasonable control, including natural disasters, internet outages, or third-party service failures.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
19. No Waiver
Failure by Marketmoto Technologies to enforce any right or provision does not constitute a waiver of that right or provision.
